Abstract. The paper discusses the academic entrepreneurship and its public 
(institutions) and private (personal) forms. We argue that academic entrepreneurship 
should involve activities and organizational structures, which are not targeting 
profit. Then - about the unsuitability of Decree N 61 of May 2, 200 on the terms and 
conditions for the creation of commercial companies by public higher education 
institutions for the purposes of the economic realization.
